In our recent blog post we reported that Clean Water Action filed a citizen suit on October 28th alleging that Waste Treatment Corporation (WTC) continues to illegally discharge oil and gas drilling wastewater into the Allegheny River in Warren, PA. Just last week (11/25), DEP stated that it has reached a proposed consent decree with WTC concerning the facility's discharges. The consent decree, open for public comment until 12/23, is intended to settle ongoing NPDES permit violations and would additionally require WTC to make upgrades to meet Chapter 95 discharge requirements for TDS and chloride by January 2016.
